RETURN, CANCELATION, AND REFUND POLICY

  1. Please read this Return, Cancelation and Refund Policy (hereinafter – «Policy») carefully. This Policy is based on our Terms of Use (located at https://3dlook.me/terms-of-service/), the applicable Service Agreement between you and 3DLOOK (as defined in the  Terms of Use ) and contains additional information regarding the rights and restrictions for your use of the 3DLOOK software, products or services. Please, read carefully the mentioned Terms of Use (and documents incorporated therein by reference, including the Service Agreement, if applicable) and our Privacy Policy (located at: https://3dlook.me/privacy-policy/) in order to get the necessary understanding of our rules and policies regarding the Services of 3DLOOK. If you do not agree with any provision herein or in the mentioned Terms of Use and/or Privacy Policy – you should not use Services of 3DLOOK.

 

Capitalized terms used but not defined herein shall have the respective meanings given to them in the Terms of Use. 

 

This Policy applies to refund requests connected to your access to/use of any 3DLOOK software, products or services (hereinafter collectively referred to as “Service(s)”).

 

BE AWARE THAT, AS A GENERAL RULE, OUR SERVICES ARE NOT SUBJECT TO RETURN AND/OR REFUND, EXCEPT FOR THE CASES DIRECTLY POINTED HEREIN.

2. If it shall be decided that you are entitled for refund, refund can be made:

  • partially;
  • in full.

Full refund can be made only in case of absolute inability to use the Services (as determined by us) due to our fault. Partial refund can be made only for the part of unused/undelivered Services in accordance with the foregoing provisions of this Policy.

3. Given the nature of the Services, a refund (full or partial) on a purchase is NOT granted unless it is proven (as decided at our sole discretion) that due to our fault the Services cannot be accessed, downloaded and/or installed, if Services contain unexpected errors when we declared that there is no such errors, has sufficiently different functioning than the one described by us on the Website, Terms of Use or the respective Service Agreement, or a refund is required under the applicable consumer protection law, or if otherwise specified in the Terms of Use (and documents incorporated therein by reference).

 

4. There is generally NO obligation to provide a refund in situations like the following, but not limited to:

  • you have changed your mind about the Services;
  • you purchased the Services by mistake;
  • you do not have sufficient expertise to use the Services;
  • you ask for goodwill;
  • you can no longer access the Services because of your technical problems and/or changes;
  • before your access to (possibility to use) the Services been stopped/canceled/blocked/etc., you’ve used the Services for illegal, unethical or questionable activity; or
  • before your access to (possibility to use) the Services been stopped/canceled/blocked/etc., you’ve used the Services in any way not expressly permitted by the Terms of Use (and documents incorporated therein by reference);
  • you did not use the Service.

 

5. No refund for any Services can be made in case if the respective agreement between us (your access to (possibility to use) the Services) is terminated by us in accordance with Terms of Use (and documents incorporated therein by reference) because of:

  • your material breach of Terms of Use (and documents incorporated therein by reference);
  • your inappropriate use of the Services;
  • your violation of any applicable law in connection with the use of any of our Services.

All such determinations shall be made at our sole discretion.

 

  1. Notwithstanding the foregoing, if you would like to request for a refund, provide us with a description of the problem and any questions about return, cancelation, refund you should address such requests to our support service: hello@3dlook.me

 

  1. A request for a return and full refund must be made in no event later than in 14 calendar days since your purchase of the Services and only in cases of total inoperability of the purchased Services (i.e. you haven’t been able to use the Services in any way and received no commercial results from you use of/access to the Services), as shall be determined by us. Any request for a refund that was made after such term shall be considered null and void on the legal grounds.

A request for partial refund may be made in any time during your use of the Services.

8. A request for a refund should include:

  • your contact information that you have provided during registration/start of use of the Services (e.g. valid email address, name of legal entity/your first and second name);
  • your account details (e.g. your ID, login);
  • country (of your citizenship/registration of a legal entity);
  • date of the purchase and tariff plan (if applicable) or price;
  • detailed description of a problem with stating a cause of your request.

Your request shall not be considered if the data mentioned above is not included into a request in full.

 

  1. We recommend contacting us for assistance if you experience any issues receiving, using or downloading our Services.

 

  1. All the decisions about the necessity of satisfaction of your request should be done at our sole discretion, unless legally required otherwise. The criteria in accordance to which the Services are considered unsatisfactory are determined by our specialists in each case. Depending on such determination, you shall be informed if you are entitled for refund or not within 7 calendar days after your request been received.

 

  1. In case we need some additional data from you (e.g. in order to determine was there any kind of violation of Terms of Use (and documents incorporated therein by reference)) we will provide you with an inquiry for such additional data within 5 calendar days after your request been received.

You will have 5 calendar days after you received our inquiry to provide us with the additional data we asked for.

In case you haven’t provided necessary additional data, we may interpret controversial facts (if any) in order to protect ourselves (e.g. you haven’t provided requested data to confirm there were no violation of applicable law – we may interpret your failure in a way that there is sufficient reason to believe that violation had occurred).

 

  1. If your request is made in accordance with the terms of this Policy, applicable consumer protection law and considered by us as reasonable and well-grounded, we will make the reimbursement without undue delay and within 30 calendar days after we confirmed you are entitled for refund.

We will make the reimbursement using the same means of payment as you used for the initial payment unless you expressly request otherwise, and we agreed to other way of refund.

 

  1. Be aware that you may be subject to your local laws and, therefore, some different rules may apply to you in connection with returns and refunds. Consider consulting with a legal counsel in a relevant jurisdiction.

 

Acknowledgment. IN ACCEPTING THIS POLICY, THE USER ACKNOWLEDGES THAT THE USER HAS READ THIS POLICY AND ALL THE INCORPORATED DOCUMENTS, UNDERSTANDS THEM, AND HAD AN OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE PRIOR TO AGREEING TO IT. IN CONSIDERATION OF 3DLOOK AGREEING TO PROVIDE THE SERVICES, THE USER AGREES TO BE BOUND BY THIS POLICY.
